Your mystery smurf is a Kinder Egg Smurf... The Shiver Smurf with the pink scarf is from the Kinder Ferrero Set featuring Soccer Smurfs (known as Footballer Smurfs in Europe). This set was released in 1990.

1990 Kinder Smurfs - Soccer Set

KINDER SMURFS - Kinder Smurfs are little Smurfs that come from Kinder Surprise chocolate eggs. Each egg has a little toy inside. Each toy comes with a sheet of paper (called "BPZ") that shows the whole set and a cute little comic (shown above). You have to assemble the Smurf together when you first open the egg. Kinder Eggs come with a variety of toys inside, not just Smurfs.

I think it may be a modified pupil smurf, but hoping it's real.

I found this pic on Mercado Livre (a Latin American auction website) and got quite curious for the seller announced these Smurf figures as belonging to Kinder trademark (2010). In other occasions I'd already seen some of them before, chiefly Clumsy - in his usual attitude when anguished - but I'm really in doubt whether they're really Kinder ones. What do you all think about?

They really are Kinder Smurfs. The set of 8 Smurfs (including Gargamel) are from the 2010 / 2011 series.
