Topic: To avoid legal issues in writing a fanfic

I just would like to know what aspects of writing fan fictions are illegal (if any)and just to play on the safe side, how may I avoid these issues?

Well, at the begining you should put down a disclaimer that let's the readers know that you are just borrowing the characters and that you are not profiting in the writing of the story. Although if you do create a character you must add that those characters are yours, but most importantly you are not making a dime out of your story. You are just writing for fun about characters that already exist.

I usually put this on the opening pages to my EMPATH stories on my website:

I have another set of questions. Do I need to ask permission from the original creators? If so, how do I get their permission? About fanfiction.net, what is accepted on that site and what is not permitted on the site?

At I and Vic said, all you need is to mention that the Smurfs are not your original characters. You are only using them for your story. There are a lot of fanfiction writers, and as long as you are not taking these characters and making money on them publically, you are ok using them in your story.
